Permitted Uses of Music Audiofiles
Audiofiles offered on this site are provided for free, legal download along with a few restrictions specified in the following guidelines:
Unrestricted personal listening use of audiofiles is permitted. This includes listening to audiofiles on a personal computer, transfer of audiofiles to a personal listening device (i.e., iPod or MP3 player) sending an audiofile via email or burning a copy of audiofiles to give to a friend or family member as a Gift.
Re-distribution of audiofiles to others and charging a fee of any kind for them is not permitted and violates current copyright law on all audiofile sound recordings.
The use of audiofiles by a company for on hold listening, or as a soundtrack for a broadcast or non-broadcast commercial, or as part of a custom CD to send as a gift to clients, and/or as background music for your company's Christmas e-card is not permitted.
Companies are, by definition, for-profit ventures whether or not the immediate use appears to have a direct profit motive or not. The use of audiofiles by non-profit organizations in non-profit settings is permitted, as long as artist credit is given, where possible (i.e. written credit). We realize that some companies may have an interest in the use of these audiofiles as part of a product or a gift. Since we do not hold the copyrights to these audiofiles, we do not have the authority to grant permission for their use. FIY: Fair Use Act is Dated 1988 and 1993

Fair Use and Copyright Considerations

17 U.S.C. 107 (1988 & Supp. IV 1993). Section 107 provides in part:

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.
